Poppers is not considered a drug
In the meantime, it has been confirmed several times that poppers do not fall under the narcotics law e.g. in Switzerland. This is because poppers are not classified as a drug. This fact is confirmed by several Ministeries in Vienna.
Poppers – legal or illegal?
For example, Swissmedic confirmed that Poppers is not covered by the Medicines Act. The reason given by the Swiss Agency for Therapeutic Products was that there was simply no medical purpose. The European Court of Justice is of the same opinion. In a ruling in 2014, it stated that poppers do not fall under the Medicinal Products Act. According to the ECJ’s interpretation, the relevant legal text (substances that “influence” physiological functions – see Section 1 para. 1 AMG) therefore does not include substances that influence physiological functions but do not have a positive effect on human health. The BASG in Vienna writes: “Poppers” do have a physiological effect (short-term vasodilatation), but this is not suitable for having a positive effect on human health. It was argued that a therapeutic effect that could cure or prevent a disease would have to be scientifically proven. Since such an effect cannot be proven for “poppers”, the designation as a functional medicinal product is inappropriate. Consequently, “poppers” can no longer fall under the provisions of the Medicinal Products Act and therefore no longer fall under the jurisdiction of the BASG.
In addition, poppers fall under the relatively comprehensive and strict Chemicals Act. While consumption and possession of poppers is considered legal, sale of the product is only permitted under certain conditions.
The ingredients decide
A large part of all ingredients of poppers consists of nitrites or alkyl esters of nitrous acid. Due to the large variety of nitrites, it is precisely differentiated which nitrites are available illegally or legally. The carcinogenic and aspiration-toxic effects of some nitrites are so strong that their ingestion could even be fatal if accidentally swallowed.
